341 Zoom Meetings

MIDDLE DISTRICT OF FLORIDA TAMPA & FORT MYERS DIVISIONS

Virtual Section 341 Meeting of Creditors Information for 11 U.S.C Section Chapter 12, and 13 Cases

At least 14 days prior to the 341 meeting, or within another timeframe requested by the trustee, the debtor or the debtor’s attorney, if represented, should send by mail or fax to the trustee the following:

Personal Identification
• A clear copy of (1) a government-issued photo identification of the debtor and (2) evidence of the debtor’s Social Security number (“ID documents”). Financial Information • Evidence of current income (payment advices or other documentation if no pay advices), for the six month period ending on the last day of the month preceding the month of the the petition date.
• Statements for each of the debtor's depository and investment accounts, including checking, savings, and money market accounts, mutual funds and brokerage accounts for the time period that includes the date of the filing of the petition.
• Above median debtors must also provide documentation of monthly expenses claimed by the debtor if these claimed expenses include any amount over the IRS Local Standard allowance; and expenses that support a claim of special circumstances. Tax Returns A complete copy of the debtor's federal income tax return for the 2 most recent tax years ending immediately before the commencement of the case and for which a return was filed, including any attachments. Debtors are expected to appear at their virtual Meeting by video:

If a debtor is unable to appear at the virtual Meeting by video due to no access to internet or to an electronic device with a camera, they should join the Meeting by audio only and let the trustee know they do not have the means necessary to join by video as the trustee may permit a debtor to participate by telephone on a case-by case basis if the circumstances warrant. If a creditor or other interested party is unable to join by video, they may join by audio only.
Please note that telephonic appearances by the debtor will likely result in the rescheduling of their Meeting to another date or time in order to appear by video. This may be called a continued, adjourned meeting or the Trustee may decide to file a motion to dismiss the case. The parties will use the same connection information that is contained in the Notice of Bankruptcy Case to connect to the continued or adjourned meeting, unless the trustee indicates otherwise. In addition, in rare cases, the Trustee may determine that an in-person 341 meeting is necessary.
Participants are encouraged to, at least one day before their scheduled Meeting, test Zoom and download the Zoom application, if applicable. The free version of Zoom should meet all of your needs to join the Meeting. Debtors: Debtors must fill in their Full Name in Zoom when joining the meeting (see example) !!
Attorneys: Please use your Name, but most importantly identify whom you represent for the current day's meetings!! I.E. put the debtors name of whom you represent, if you are here on behalf of a creditor make that known and for which debtor's case.
